In pluralist societies, stakeholders in healthcare may have different experiences of and moral perspectives on health, well-being, and good care. Increasing cultural, religious, sexual, and gender diversity among both patients and healthcare professionals requires healthcare organizations to address these differences. Addressing diversity, however, comes with inherent moral challenges; for example, regarding how to deal with healthcare disparities between minoritized and majoritized patients or how to accommodate different healthcare needs and values. Diversity statements are an important strategy for healthcare organizations to (...) define their normative ideas with respect to diversity and to establish a point of departure for concrete diversity approaches. We argue that healthcare organizations ought to develop diversity statements in a participatory and inclusive way in order to promote social justice. Furthermore, we maintain that clinical ethicists can support healthcare organizations in developing diversity statements in a more participatory way by fostering reflective dialogues through clinical ethics support. We will use a case example from our own practice to explore what such a developmental process may look like. We will critically reflect on the procedural strengths and challenges as well as on the role of the clinical ethicist in this example. (shrink)

Nudging policies rely on behavioral science to improve people's decisions through small changes in the environments within which people make choices. This article first seeks to rebut a prominent objection to this approach: furnishing governments with the power to nudge leads to relations of alien control, that is, relations in which some people can impose their will on others—a concern which resonates with republican, Kantian, and Rousseauvian theories of freedom and relational theories of autonomy. I respond that alien control can (...) be avoided, if nudging is suitably transparent and democratically controlled. Moreover, such transparency and democratic control are institutionally feasible. Building on this response, I then provide a novel and surprising argument for more nudging: democratically controlled public policy nudging can often contain the power of private companies to nudge in uncontrolled and opaque ways. Therefore, reducing alien control often requires more rather than less nudging in public policy. (shrink)

This chapter offers a reinterpretation of Heidegger’s conception of the social world in order to overcome the tension between its conflicting positive and negative characterisations in Being and Time. Rejecting a purely positive or a purely negative reading of das Man, the chapter follows Stephen Mulhall in carving out a middle ground between the two. The chapter takes seriously Heidegger’s claim that it is possible for das Man to undergo an authentic transformation, exploring how best to conceive of this idea. (...) It is argued that the authentic transformation of das Man and the everyday way of being it engenders, is most productively understood with reference to Dasein’s relation to das Man and the way Dasein grasps the world as meaningful. Through this reading it is shown how both an authentic and an inauthentic mode of everydayness can be accommodated. The chapter concludes with an examination of the consequences of this interpretation, arguing for the critical and political potential of authenticity as an attentive and engaged mode of being-in-the-world. This article contributes to the analysis of refusal to license cases as abuse of a dominant position pursuant Article 82 EC from an economic perspective. In the Microsoft case, the European Commission introduced an "Incentives Balance Test" to assess whether the refusal to give access to interface information can be justified by arguing that this information is protected by Intellectual Property Rights (IPRs): The Commission argued that if the overall innovative effects evoked by a compulsory license are significantly higher than (...) without this access, the IPR owner is obliged to license. This should be assessed through balancing the different incentives to innovate between the dominant firm and its competitors. In the paper we pursue two objectives: Firstly, we analyze to what extent the decision of the Court of First Instance, which confirmed the decision of the Commission, helps to clarify the criteria in refusal to license cases; in fact, it is disappointing in this regard. Secondly, we demonstrate that the basic idea of the Incentives Balance Test can be interpreted as a test whether the specific IPRs of the dominant firm can be defended from the perspective of the economics of IPRs. This implies that Article 82 allows competition law to correct economically not optimal IPRs through a specific economic analysis. This is followed by a broad overview on theoretical and empirical insights from economics of IPRs, innovation economics and competition and network economics that can help to develop a more general and sophisticated Innovation Effects Test that can be applied in Article 82 refusal to license cases. This volume features a collection of essays on consciousness, which has become one of the hot topics at the crossroads between neuroscience, philosophy, and religious studies. Is consciousness something the brain produces? How can we study it? Is there just one type of consciousness or are there different states that can be discriminated? Can consciousness, in deep states of meditative absorption, actually access some aspect of reality which we normally don't? Meditation research can potentially foster us with a new access to the phenomenological method in general. This has even been branded with a new catch-phrase: Contemplative Science. It brings together the most modern neuroscientific approach and the most advanced phenomenological methodology of studying the mind from within, through highly skilled self-observation that has gone through many thousand hours of honing the capacity to look carefully, without distraction. This book addresses these issues by bringing together some of the leading researchers and thinkers in the field. The scope of the volume reaches from first person neuroscience to Indian philosophy, from pedagogic applications to epistemological aspects and from compassion meditation to the study of brain activity. In Sweden, palliative care has, over the past decades, been object to policies and guidelines with focus on how to achieve “good palliative care”. The aim of this study has been to analyse how experts make sense of the development and the current state of palliative care. Departing from this aim, focus has been on identifying how personal experiences of ‘the self’ are intertwined with culturally available meta-level concepts and how experts contribute to construct new scripts on palliative care. Twelve (...) qualitative interviews were conducted. Four scripts were identified after analysing the empirical material: 1. script of paths towards working within palliative care; 2. script of desirable and deterrent reference points; 3. script of tensions between improvement and bureaucracy; and 4. script of low status and uncertain definitions. The findings of this study illustrate how experts in complex ways intertwine experiences of ‘the self’ with meta-levels concepts in order to make sense of the field of palliative care. The participants did not endorse one “right way” of “good” deaths. Instead, palliative care was considered to be located in a complex state where the historical development, consisting of both desirable ideals, death denials and lack of guidelines, and more recent developments of strives towards universal concepts, “improvement” and increased bureaucracy altogether played a significant role for how palliative care has developed and is organised and conducted today. Sandra Lee Bartky criticises the account of meaning contained in Heidegger's ontology in Being and Time. In her view, Heidegger must choose between the claim that meaning is received and the claim that it is created, but is unable to do so. This paper argues that Bartky's criticism is misconceived, by showing that meaning, as Heidegger understands it, is necessarily both created and received. According to a number of influential commentators, the ultimate source of meaning is das Man – Heidegger's (...) conception of the social world. This paper initially considers, but ultimately rejects, the view that the source of meaning, as Heidegger presents it, is social. Instead, this paper argues that meaning is rooted in what Heidegger calls ‘letting be’. Letting be articulates a distinctive relationship between the human being (Dasein) and entities. This relationship, it is argued, accommodates the notion of meaning as both received and created, by reconstituting these terms within a context that defines the human being as an interpreting entity, therefore showing that letting be should be understood as the ultimate source of meaning in Heidegger's ontology. The aim of this paper is to connect the traditional epistemological issue of justification with what one might call the “new reasons paradigm” coming from the philosophy of action and metaethics. More specifically, I will show that Conee and Feldman’s mentalism, a version of internalism about justification, can profitably be spelled out in terms of subjective normative reasons. On the way to achieving this aim, I will argue that it is important to ask not just the oft-discussed ontological question about (...) epistemic reasons—what kind of entities are they?—but also: Reasons in which sense are fundamental to justification? Background Increasing social pluralism adds to the already existing variety of heterogeneous moral perspectives on good care, health, and quality of life. Pluralism in social identities is also connected to health and care disparities for minoritized patient (i.e. care receiver) populations, and to specific diversity-related moral challenges of healthcare professionals and organizations that aim to deliver diversity-responsive care in an inclusive work environment. Clinical ethics support (CES) services and instruments may help with adequately responding to these diversity-related moral challenges. However, (...) although various CES instruments exist to support healthcare professionals with dealing well with morally challenging situations in healthcare, current tools do not address challenges specifically related to moral pluralism and intersectional aspects of diversity and social justice issues. This article describes the content and developmental process of a novel CES instrument called the Diversity Compass. This instrument was designed with and for healthcare professionals to dialogically address and reflect on moral challenges related to intersectional aspects of diversity and social justice issues that they experience in daily practice. Methods We used a participatory development design to develop the Diversity Compass at a large long-term care organization in a major city in the Netherlands. Over a period of thirteen months, we conducted seven focus groups with healthcare professionals and peer-experts, carried out five expert interviews, and facilitated four meetings with a community of practice consisting of various healthcare professionals who developed and tested preliminary versions of the instrument throughout three cycles of iterative co-creation. Results The Diversity Compass is a practical, dialogical CES instrument that is designed as a small booklet and includes an eight-step deliberation method, as well as a guideline with seven recommendations to support professionals with engaging in dialogue when they are confronted with diversity-related moral challenges. The seven recommendations are key components in working toward creating an inclusive and safe space for dialogue to occur. Conclusions The Diversity Compass seeks to support healthcare professionals and organizations in their efforts to facilitate awareness, moral learning and joint reflection on moral challenges related to diversity and social justice issues. It is the first dialogical CES instrument that specifically acknowledges the role of social location in shaping moral perspectives or experiences with systemic injustices. However, to make healthcare more just, an instrument like the Diversity Compass is not enough on its own. In addition to the Diversity Compass, a systemic and structural approach to social justice issues in healthcare organizations is needed in order to foster a more inclusive, safe and diversity-responsive care and work environment in health care organizations. Context: Philosophical debates in recent decades have developed new ways of dealing with old philosophical problems such as reality, truth, knowledge, language, communication, and action. These new approaches deserve serious consideration because they can improve the discourse of radical constructivism. Problem: This paper discusses the following problem: How can we overcome dualistic and ontological approaches to basic philosophical problems – problems that are relevant to all scientific domains? Method: The method applied here can be roughly described as a transition from (...) entities/substantives/identities to actions and processes, the actions and processes from which so-called entities result. Action-orientation – or an actor-based process – is necessarily combined with sense-orientation as provided by culture and society. Results: The paper demonstrates how the problems mentioned above can be reformulated in a non-dualistic and non-ontological way. Implications: Opening up constructivist thinking to insights provided by neighbouring philosophical approaches facilitates interdisciplinary cooperation and helps overcome dualistic remnants – as well as the cognitive one-sidedness of traditional constructivism. Can associative learning take place without awareness? We explore this issue in a sequence learning paradigm with amnesic and control participants, who were simply asked to react to one of four possible stimuli on each trial. Unknown to them, successive stimuli occurred in a sequence. We manipulated the extent to which stimuli followed the sequence in a deterministic manner (noiseless condition) or only probabilistically so (noisy condition). Through this paradigm, we aimed at addressing two central issues: first, we asked whether (...) sequence learning takes place in either condition with amnesic patients. Second, we asked whether this learning takes place without awareness. To answer this second question, participants were asked to perform a subsequent sequence generation task under inclusion and exclusion conditions, as well as a recognition task. Reaction times results show that amnesic patients learned the sequence only in the deterministic condition. However, they failed to be able to reproduce the sequence in the generation task. In contrast, we found learning for both sequence structures in control participants, but only control participants exposed to a deterministic sequence were successful in performing the generation task, thus suggesting that the acquired knowledge can be used consciously in this condition. Neither amnesic nor control participants showed correct old/new judgments in the recognition task. The results strengthen the claim that implicit learning is at least partly spared in amnesia, and the role of contextual information available for learning is discussed. © 2006 Elsevier Ltd. Schiller's political thought has been subject to conflicting interpretations. Taking Schiller's historical essay The Legislation of Lycurgus and Solon as a point of departure, this article locates him more precisely within the context of eighteenth-century debates on republicanism and moral philosophy. One of Schiller's central criteria in the evaluation of different republics is the question of how they comply with man's sensual and passionate nature. By attacking Sparta's constitution as despotic and unfit to meet human self-realization, he dissociated himself from (...) Rousseau and repudiated classical republican models. Instead, Schiller sided with modest proponents of luxury and progress by defending Athens' abundant and polite lifestyle. In response to the French revolution, Schiller developed his own aesthetic model of cultivating senses and passions to achieve a free society. Despite significant liberal elements, he thereby remained true to the republican principle that freedom and self- realization can only be achieved in the political community. (shrink)
